I discussed the potential charge of accessory after the fact with a friend (senior prosecutor) at the Orange County (CA) District Attorney’s Office. As I’ve mentioned on this blog before, I spent 21 years working there. Our consensus is that such a prosecution might depend on a couple of facts. It appears that it was his stated intent to help the shooter escape, even though he had no idea who the shooter was.
The short answer is “yes”, and he can be sentenced (up) to life in prison when the crime is murder, unless he can offer some mental defense. In Utah, the Elements of the crime are the same, but their statutes process the matter slightly differently than in California.
According to Google AI: “In Utah, ‘accessory after the fact’ is not a distinct crime but is instead incorporated into other criminal statutes, primarily Obstruction of Justice. A person who helps a known felon avoid detection or capture can be charged as if they had committed the underlying felony.

At that point in the conflict, the British carried the single-shot Martini-Henry rifle. Initially, the British formed a standing line of redcoats, but as they were dropping like flies, they abandoned their disciplined fighting formation.
Anstruther refused, but before he could move his column into skirmish formation, the Boers opened fire at 12:30 pm. Within fifteen minutes, most of the officers were killed or wounded, and the horses and oxen pulling the covered wagons at the front and rear of the column were killed, preventing any movement. Shocked by the sudden and aggressive nature of the attack, Lt. Col. Anstruther gave the order to surrender.
In a battle lasting just fifteen minutes, 156 British soldiers were killed or wounded, with the rest taken prisoner. Reported Boer casualties were only two dead and five wounded. Anstruther was himself wounded during the fight and died on the 26th of December, following the amputation of one of his legs.

Interestingly the Mauser adopted in 1894 by the Prussian Army had a 8 round tubular magazine. Was not that successful and became the 1898 with 5 round, box magazine.
Cowboy on horse – while going through one site that had lots of old B&W photos I came across one of a cowboy on a horse. Guy looked like he chewed steel plates and spit out rivets. The note on the picture gave the name and location. Location was where I grew up, last name was the same as a boy in the class one grade behind me.
